How significant is the youth-led constitutional climate trial in Montana and what are its implications? As the first-ever trial in the U.S. in a climate change lawsuit, Held v. Montana, set for June 12-23, is historic. Plaintiffs — 16 young Montanans — sued the state over its energy policies claiming the state’s actions have violated their constitutional right. The right they claim is the right to “a clean and healthful environment” as mandated by the Constitution of Montana, which reads: “The state and each person shall maintain and improve a clean and healthful environment in Montana for present and future generations.” They argue that the state government supports, promotes, and prioritizes fossil fuels, impacting climate change and disproportionately harming them.
